JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 489B, 489C/ 34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 28.09.2016 passed in Cr. Misc. No. 37521 of 2016 and again the bail of the petitioner is sought on the ground that co-ordinate Benches of this court have already granted bail to co-accused persons by passing two separate orders which are annexed as Annexure-3 and 4 to this petition. No doubt, the co-ordinate Benches of this Court have granted privilege of bail to other co-accused persons but in my

Patna High Court Cr.Misc. No.9211 of 2017 (2) dt.12-04-2017 2/2 view, it is not a fit case for grant of bail to petitioner and accordingly, his prayer for bail in connection with Sessions Trial No. 326 of 2016 arising out of A.T.S. P.S. Case No. 02 of 2015 pending in the court of Additional Sessions Judge-XI, Patna stands rejected.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.

Let a copy of this order be sent to Senior Superintendent of Police, Patna with direction to him to ensure the presence of prosecution witnesses of aforesaid case before the trial court without any delay so that the trial court could conclude the trial of the petitioner as early as possible.
