The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 337, 338, 307, 420, 120B of the Indian Penal Code, 27 of the Arms Act, sections 33/41/42 of the Indian Forest Act, section 4 (1),(1A) of the Mines and Minerals (Development and Regulation) Act and Rule 40(1) of the Bihar Minor and Minerals Concession Rules.
Prosecution case is that the police raided the place at Gopi Bigha where stones crushing unit was being run illegally when crusher unit was seized then the mob of 400-500 villagers attacked on the police force, pelted stones and resorted to fire, as a result, several police personnel received injuries.
Patna High Court Cr.Misc. No.9083 of 2016 (2) dt.26-02-2016 2/2 It is submitted by learned counsel for the petitioner that the accusation is against the mob and none has received any fire arm injury. The FIR was lodged against 26 named and 400-500 unknown though the petitioner was named but the accusation is not specific. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Dihri, Rohtas in connection with Dihri (T) P.S. Case No.251/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
