Learned counsel for the petitioners undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioners are apprehending their arrest in a case
Patna High Court CR. MISC. No.12297 of 2022(2) dt.04-08-2022 2/3 registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
Petitioners are said to have committed murder of the husband of the informant.
It is submitted by learned counsel for the petitioners that petitioners are innocent and have been falsely implicated in this case. He submits that there is no eye witness to the alleged occurrence and only on suspicion, petitioners have been made accused. He further submits that petitioners have four criminal antecedent as stated in para-3 of this application. Learned APP for the State opposes the prayer for bail and submits that a day before occurrence, petitioner Rambabu has taken the informant's husband from his house. There are allegation of land grabby and outraging the modesty of the informant.
Considering the seriousness of offence, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Kathaiya P.S. Case No. 26 of 2021.
