The petitioner is an accused in connection with Began Gola P.S. Case No. 55 of 2016, registered under Sections 147,148, 149, 341, 323, 307, 302, 379 and 504 of Indian Penal Code and Section 27 of the Arms Act, pending in the Court of Chief Judicial Magistrate, Buxar.

The accusation is that due to land dispute, petitioner and six other named in the F.I.R. caused assault to the father of the informant through lathi, stick, fists and slaps thereafter father of the informant succumbed to his injury.

Learned counsel appearing on behalf of the petitioner submits that there is general and omnibus allegation against the petitioner and other to cause injury to the father of the informant, who

Patna High Court Cr.Misc. No.9700 of 2017 (3) dt.30-03-2017 2/2 died due to the injury. Further submission is that no specific overt act has been attributed against the petitioner. The petitioner is in custody since 26.10.2016.

Learned counsel for the State vehemently opposed the prayer of the petitioner and submits that four injuries were found on the person of the deceased, father of the informant. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
