The petitioner seeks bail in connection with Korha P.S. Case No. 491 of 2019, registered under Sections 399 and 402 of the Indian Penal Code and Sections 26(1-b)a, 26 and 35 of the Arms Act.

The accusation is that on receiving the information about gathering of miscreants for making plan to commit heinous offence at Dighri canal, the informant along with other Police personnel reached there, where several persons were seen. On seeing the Police party, all started fleeing, but five were apprehended, who disclosed their names Arnav Kumar, Tanwir Alam, Arjun Kumar Sah, Sauttan Kumar Mandal (Petitioner) and Badal Husain. On search,

No.10084 of 2020(2) dt.29-02-2020 2/2 Arnav was found in possession of one loaded pistol and one live cartridge, Tanwir was found in possession of one mobile set, Arjun Kumar was found in possession of mobile set and petitioner was also found one Samsung mobile set. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 30.11.2019 and no incriminating material has been recovered from the possession of the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No. 491 of 2019. Out of two sureties one surety must be parent/close relative of the petitioner.
