JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 This is an application for grant of anticipatory bail in connection with Chanan P.S. Case No. 58 of 2018, disclosing offences under Sections 16, 18, 20, 23 of the U.A.P. Act and Section 4/5 of the Explosive Act.
Allegation as per F.I.R. is that police raided the place of occurrence and accused persons started fleeing away, but one person namely Gurucharan Soren arrested, who named the petitioner and other accused persons and further 40 kg of Ammonium Nitrate was recovered.
Submission of learned counsel for the petitioner is that there is no specific allegation has been attributed against the petitioner and he has been named by co-accused person and one of the co-accused person has been granted privilege of anticipatory bail by a Coordinate Bench of this Court.
Patna High Court CR. MISC. No.11621 of 2019(3) dt.29-04-2019 2/2 Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner is accused in one more case, which appears from the case diary, which has not mentioned in the petition. Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender before the court below within a period of six weeks and make prayer for regular bail, which will be considered on the basis of materials available on record, without being prejudice by order of this Court.
Accordingly, this application is dismissed.
