The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 323, 324 341, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, while Atma Bind and his wife are said to have caught hold of the husband of the informant, the petitioner gave a chura blow in his stomach leading to serious injuries.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case due to previous enmity. No case under section 307 of the Indian Penal Code is made out. The petitioner is in custody since 15.9.2021 and charge-sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation of the petitioner having given a chura blow in the stomach of the husband of the informant which is supported from the contents of the injury report, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
