This application has been filed for restoration of Criminal Misc. No. 32074 of 2013, which stood dismissed for none compliance of the order dated 06.02.2017. Learned counsel for the petitioner submits that due to mistake, petitioner could not take steps within the stipulated period for sending the notice to opposite party no. 2 in compliance of the order dated 06.02.2017. It is further submitted that petitioner has filed requisites for sending the notice to the opposite party no. 2 on 23.03.2017.
On being satisfied with the reasons furnished in this
Patna High Court Cr.Misc. No.18496 of 2017 (2) dt.26-04-2017 application, the same is allowed and the Criminal Misc. No. 32074 of 2013 is restored to its original file and number. Office is directed to proceed accordingly.
