JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2015 Heard learned counsels for the petitioner and the State. The petitioners being the present and Ex-Panchayat Mukhiyas are apprehending arrest in a case registered for the offences punishable under Sections 420 and 409/34 of the Indian Penal Code.

The accusation is of purchasing the solar lights between 2006 to 2013 from the agency other than BREDA or BELTRON. It is submitted by learned counsel for the petitioners that the purchase was made with approval of Aam Sabha of Gram Panchayat and no letter was circulated to the petitioners' Panchayat before the actual purchase for purchase of the solar

Patna High Court Cr.Misc. No.11330 of 2015 (2) dt.19-03-2015 2/2 lights from BREDA or BELTRON. It is further submitted that similarly situated Panchayat representatives of different Panchayat have been granted bail.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Arrah in connection with Udwant Nagar P.S. Case No. 365 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
