JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Fesar Case No.33 of 2016 for the offence under Sections 399, 402, 414 of the Indian Penal Code 25 (1-B)a, 26 and 35 of Arms Act.

It is alleged that the police apprehended five persons including the petitioner. It is further alleged that arms and ammunitions and cash were recovered from the possession of Krishna Kumar and Sanjay Nonia @ Kaila. As per seizure list there is no recovery from the possession of the petitioner. It has been mentioned in para 3 of the petition that the petitioner has clean antecedent.

Patna High Court Cr.Misc. No.8714 of 2017 (2) dt.10-03-2017 2/2 bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Sandip Agnihotri, J.M.,1st Class, Aurangabad, in Fesar P.S. Case No.33 of 2016 subject to the condition that both the bailers shall be the close relative of the petitioner.
