JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The petitioner is in custody since 06.12.2016 in connection with Maner P.S. Case No. 541 of 2016, registered for offences punishable under Sections 30(a) of Bihar Excise (Amendment) Act, 2016.
It has been submitted on behalf of the petitioner that though there is allegation of recovery of 25 litres of mahua liquor, however the petitioner has been sufficiently punished for the said offence as he has been in judicial custody since 06.12.2016 and he has no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, nature of offence and period of custody, let the petitioner above named, be released on bail on
Patna High Court Cr.Misc. No.10234 of 2017 (2) dt.06-03-2017 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur, District-Patna, in connection with Maner P.S. Case No. 541 of 2016.
It is also made clear that if the petitioner again found involved in any of such offence, in future, the prosecution will be free to move for cancellation of his bail bonds. (Vinod Kumar Sinha, J) sunil/- U
