The petitioner has renewed his prayer for bail in a case registered under sections 302 and 120B of the Indian Penal Code and section 27 of the Arms Act.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner along with two others namely Manish Kumar @ Mohan Jee and Mannu Singh was rejected vide order dated 2.6.2020 (Annexure-1) passed in Cr. Misc. no.8151 of 2020 with the observation that the prayer for bail of the three petitioners including the petitioner herein was being rejected for the present. It is further submitted that subsequent thereto co-accused Manish Kumar @ Mohan Jee has been enlarged on bail vide order dated

Patna High Court CR. MISC. No.22971 of 2021(2) dt.16-11-2021 2/2 28.10.2021 passed in Cr. Misc. no.22847 of 2021 and coaccused Mannu Kumar @ Mannu Singh has been enlarged on bail vide order dated 12.7.2021 passed in Cr. Misc. no.7514 of 2021. The petitioner is in custody since 9.10.2019 and undertakes to co-operate in the trial in the learned court below. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 2 years and grant of bail to above named co-accused, the Court directs the petitioner to be enlarged on bail in connection with Gwalpara P.S. Case no.184 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge Ist, Madhepura.
