ABHISHEK REDDY ORAL ORDER 30-06-2026 Learned counsel appearing on behalf of the petitioner submits that the Respondent No. 7 herein was a tenant of the petitioner and he has consumed the electricity and not paid the charges. Learned counsel submits that though the Respondent No. 7 has agreed to pay 50 per cent of the outstanding due amount, he did not pay the same as per the terms and conditions of the agreement entered between the

Patna High Court CWJC No.3169 of 2026(4) dt.30-06-2026 2/2 petitioner and the Respondent No. 7 dated 18.12.2025. Further in the prayer portion, the petitioner is seeking extension of the time for paying the installments as directed by the Special Judge, Electricity Magadh Area, Gaya dated 09.01.2026. In case the petitioner is seeking any direction for granting of time, he has to approach the court which has granted the said concession to him.

2. This Court under Article 226 of the Constitution of India cannot adjudicate the issue involved and cannot grant the relief sought for by the petitioner. In so far as the second prayer is concerned whereas a direction is sought against the Respondent No. 7 to pay the 50 per cent of the outstanding due amount as agreed between the petitioner and the Respondent No. 7 vide agreement dated 18.12.2025, the petitioner has to approach the Civil Court for redressal of his grievance and not this Court under Article 226 of the Constitution of India.

3. Having regard to the same, the present writ petition stands disposed of.
