JUSTICE BIRENDRA KUMAR ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody in connection with Cheriabariyarpur P.S. Case No. 137 of 2016 for the offences punishable under Sections 386/387/506 of the Indian Penal Code. According to F.I.R. the petitioner is accused in the murder case of Roshan Singh, the full brother of the informant, when the informant was on the way, the petitioner intercepted him just to pressurize to compromise the case and at the point of pistol demanded ransom and snatched the money from the pocket of the informant. The record reveals that the petitioner is accused in several serious cases. He is in custody since 26.08.2016. Considering the criminal antecedent of the petitioner

Patna High Court Cr.Misc. No.16289 of 2017 (3) dt.15-05-2017 2/2 and nature of the allegation, I am not inclined to enlarge the petitioner on bail. Hence, prayer for bail of the petitioner is refused. However, the learned Court-below is directed to expedite the trial and if the trial is not concluded within nine months from the date of communication of this order, the petitioner may renew the prayer for bail before the trial Court itself.
