JUSTICE RAJIV ROY ORAL ORDER 14-05-2026 Heard Mr Sanjay Kumar, learned counsel for the petitioner, the State and also the Mines Department. 2 This writ petition has been filed for the following reliefs:

"For issuance of a writ in the nature of certiorarified mandamus for quashing the arbitrary and illegal action of the respondent authorities in blocking/closing the petitioner's ID and password appertaining to Sand Storage License No KJAMUI/87/2025 issued in Form K, vide Memo No 770 dated 04.06.2025, valid till 31.12.2026, without issuing any notice or providing any opportunity of hearing.

Patna High Court CWJC No.3811 of 2026(2) dt.14-05-2026 2/3 ii For quashing Letter No 5645 dated 07.10.2025, so far as it relates to the petitioner, by which a direction has been issued to take punitive action against all K-license holders on the alleged ground of unauthorized sale beyond the permissible limit, which is false, baseless and without any evidentiary support.

iii To call for the records and quash the order/inquiry report if any by which a fine of Rs 4,46,25,000/- has been imposed upon the petitioner. iv For issuance of a writ in the nature of mandamus commanding and directing the respondent authorities to immediately restore the petitioner's ID and password and allow him to carry on lawful business under his valid license. v For holding that the alleged ground of unauthorized sale beyond the permissible limit is not applicable in the case of the petitioner. vi For issuance of such other order (s) or direction (s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

3 The counter affidavit of the Mines Department clearly shows that only in the FIR, it has been recorded that due to the illegal act of the petitioner, the Mines Department has suffered economic loss. Learned counsel submits that the petitioner has wrongly construed it as the penalty that has been imposed upon him and no such order has been passed. 4 At this stage, learned counsel for the petitioner submits that with all the documents, he shall be approaching the Collector, Jamui for redressal of his grievance.

6 In case the petitioner files a petition in next four weeks, the Collector, after noticing/hearing the parties, it is expected that it will be disposed of at the earliest and in any case within three weeks from the date the representation is preferred.

7 The writ petition is disposed of with the aforesaid direction.
