This application for grant of regular bail arises out of Jandaha P.S. Case No. 03 of 2019, disclosing offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25 (1-b) a, 26/35 of the Arms Act. On the allegation that the petitioner and others were preparing to commit dacoity, the First Information Report was registered. The petitioner was apprehended on the spot on 08.01.2019 and since then he is in custody.

Learned counsel appearing on behalf of the petitioner has submitted that with the same allegation one co-accused Prince Kumar has been allowed regular bail by this Court by an order dated 22.07.2019 passed in Cr. Misc. No.45093 of 2019.

(7) more cases of grievous nature as under:- "(i) Mohiuddi Nagar Samastipur Police Station Case No. 202 of 2015 under Section 392 of the Indian Penal Code.

(ii) Bind Nalanda Police Station Case No. 48 of 2016 under Section 394 of the Indian Penal Code.

(iii) Badh Patna Police Station Case No. 139 of 2016 under Sections 394, 302 of the Indian Penal Code and 27 of the Arms Act.

(iv) Badh Patna Police Station Case No. 84 of 2017 under Sections 307, 353 of the Indian Penal Code and 25(1-b) a, 26/35 of the Arms Act.

(v) Badh Patna Police Station Case No. 87 of 2017 under Sections 307, 353 of the Indian Penal Code and 25(1-b) a, 26/35 Arms Act.

(vi) Fatuha Police Station Case No. 362 of 2016 under Sections 394, 302 of the Indian Penal Code and 27 Arms Act.

(vii) Jandaha Patna Police Station Case No. 312 of 2018 under Sections 302, 394 of the Indian Penal Code and 27 of the Arms Act."

No.22676 of 2021(3) dt.29-11-2021 3/3 Apparently, the petitioner, who was accused in several cases registered from 2016 came to be apprehended in 2019 with the allegation that he, along with others, was found preparing to commit dacoity. From the petitioner's possession one loaded pistol was recovered.

Considering the petitioner's criminal antecedent as noted above, I am not inclined to grant privilege of regular bail to the petitioner for the present.

This application is, accordingly, rejected.
