JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 Earlier prayer for bail of the petitioner was rejected by this Court twice vide order dated 13.11.2017 passed in Cr.Misc.No. 52540 of 2017 and vide order dated 21.6.2018 passed in Cr.Misc.No. 32713 of 2018 and allegation against the petitioner is of committing rape and causing the death of the victim.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody since 22.12.2016 and only three witnesses out of seven have been examined as yet.

Heard learned APP and perused the report, from which it appears that three witnesses have been examined. In such view of the matter, I am not inclined to grant bail to the petitioner.

No.14040 of 2019(3) dt.24-04-2019 2/2 However, learned trial court is directed to expedite the trial and at the same time, Sr.Superintendent of Police, Gaya is directed to ensure the presence of the witnesses in court on the date fixed so that the trial may be concluded at the earliest. With the above observation, this application is dismissed.
