Petitioner is in custody in connection with Sathi P.S. Case No. Sessions Trial No. 189 of 2017 arising out of Ahiyapur P.S. Case No. 504 of 2016 registered under Sections 279, 337, 338, 307, 302 and 427 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, has falsely been implicated in this case. Earlier the bail of this petitioner has been refused by this Court in Cr. Misc. No. 52017 of 2016 with observation that the prayer for bail of this petitioner may be considered after framing of charge. Now, charges have been framed in this case. The petitioner, who is driver of the alleged vehicle, is rotting in custody for the last eight months.
