The petitioners are apprehending their arrest in connection with Kako P.S.Case No.323 of 2018 , registered for offences punishable under Sections 147, 148, 149, 323, 337, 338, 307, 353, 379, 591, 333, 332, `86, 189, 504 of the Indian Penal Code.
Prosecution case as per the FIR is that there was election of Committee at Satanpur School, in which the informant was deputed for law and order duty and it is alleged that two parties clashed there assaulting each other and they also pelted stones on the police party and damaged the police vehicle.
Patna High Court CR. MISC. No.12827 of 2019(3) dt.30-04-2019 2/2 Submission of the learned counsel for the petitioners is that omnibus and general allegation has been made against the petitioners and there is no specific allegation and one of the co-accused has been granted privilege of anticipatory bail, vide order dated 1.3.2019 passed in Cr. Misc. No.12550 fo2019. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sri Umesh Pd. J.M. Ist class, Jehanabad in connection with Kako P.S.Case No.323, of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
