The petitioner seeks bail in connection with Kankarbagh P.S. Case No. 930 of 2019 dated 18.09.2019 instituted for the offences under Sections 20/22 of the Narcotic Drugs and Psychotropic Substances Act.

From the FIR, it appears that the petitioner was caught with narcotics kept in 17 packets weighing 16 grams.

The petitioner is said to be in custody since 19.09.2019.

This Court had on an earlier occasion called for a report about the stage of the case. The report has since been received and it discloses that it is still pending for framing of charge and the next date in the case was

Patna High Court CR. MISC. No.10207 of 2020(6) dt.02-11-2020 2/2 18.06.2020.

It is assumed that charges must have been framed by now.

If at all the charges have not been framed, it ought to be framed and trial be expedited and concluded. If the trial is not concluded within a period of nine months from today, it would be open for the petitioner to approach the trial court for grant of bail. In that event, the trial court would be required to state reasons for the tardy progress of the trial.
