The petitioner seeks regular bail in connection with Agamkuan P.S. Case No. 1027 of 2018 for the offences punishable under Sections 21, 27, 29 of the N.D.P.S. Act. The allegation is regarding recovery of one 'Puria' of smack wrapped in white paper from the left pocket of trouser of the petitioner.
The learned counsel for the petitioner submits that since the quantity of smack recovered from the petitioner falls under small quantity, as per the provisions of NDPS Act, 1985, it is a fit case for grant of bail to the petitioner herein. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge/ Special Judge, Patna in connection with Special Case no. 144 of 2018, arising out of Agamkuan P.S. Case No. 1027 of 2018.
