The petitioner has challenged the order dated 29.09.2012 passed by the learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 247 of 2010 in which cognizance has been taken under Sections 420, 406, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner is not in a position to inform this Court about the stage of the case. However at this stage, this Court is not inclined to interfere with the order of cognizance. In case the

Patna High Court CR. MISC. No.11344 of 2015(2) dt.07-05-2019 2/2 trial of the petitioner has not begun, he shall have the option of availing the remedies which are available to him under law.

With the aforesaid direction, the petition is disposed of.
