1. Heard learned counsel for the parties concerned.
2. The petitioner has filed the present writ application to consider the case of the petitioner for appointment as Assistant Teacher in elementary school pursuant to the advertisement no. 210/2010. The petitioner completed her teachers training course in the Sessions 1988-90 and got 56.66 % marks.
3. Learned counsel for the petitioner submits that the petitioner was considered under General category, whereas, she belongs to the OBC (Other Backward Class) category.
4. Learned counsel for the Staff Selection Commission submits that in CWJC No. 5559 of 2022 specific statement has been made in paragraph no. 7 of the writ
Patna High Court CWJC No.20197 of 2016(3) dt.09-09-2024 2/2 application that as per the records, the last candidates recommended by the Staff Selection Commission for the purpose of appointment against the remaining vacancies out of 34540 posts, in the BC category had been up to academic Session 1985-87 with 65.13% marks. Since the petitioner's session is 1988-90, the petitioner cannot be considered for appointment.

Learned counsel for the State submits that Rules have been amended from time to time and now Bihar Panchayat Elementary Teachers (Employment and Service Conditions) Rule, 2023, for appointment of teachers have been framed and as per the 2023 Rules, the appointment of teachers shall be made on regular basis through open competitive examination held by Bihar Public Service Commission.
6. In view of the stand taken by the respondent-authorities, I do not find any merit in this writ application.
