Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 33, 41, 42 of the Forest Act.

The prosecution case is that the petitioners were found excavating stones from a hill in forest area without any license or lease, but they escaped from the scene. It is submitted by the learned counsel for the petitioners that no recovery has been made from the petitioners. Only on suspicion, petitioners have been roped in the present case. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Patna High Court Cr.Misc. No.7225 of 2016 (2) dt.18-02-2016 Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Forest Case No. 16 of 2012, pending in the court of learned Chief Judicial Magistrate, Jehanabad. With the above observation this application is disposed of.
