Petitioner being the FIR names accused along with others including the husband of deceased against whom chargesheet was submitted, were not sent up for trial, been summoned under Section 319 of the Cr.P.C and that being so, petitioner, Md. Isphil, in the event of his arrest/surrender within four weeks, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge, 4th Bhojpur, Ara in Sessions Trial No. 370/2013 arising out of Barahara (Krishnagarh) PS Case No. 57/2013, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
