The petitioner seeks bail in connection with Dehri (Indrapuri) P.S. Case No.734 of 2019 registered under Sections 307, 147, 148, 149, 323 and 504 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that when the informant Hira Singh was going to Katar Balu Ghat for taking Poplane, in the way, the government land was surrounded by Kamlesh Singh and Ram Niwas Singh, who started to abuse and commit "Maar-Peet" with him and also make firing. At that time, Ajit Yadav and Deepak Kumar caused injury at the head of the informant through rod, whereas Tana Singh and Bittu Singh (petitioner)

Patna High Court CR. MISC. No.10160 of 2020(2) dt.02-03-2020 2/2 started to commit "Maar-Peet" with him through lathi and danda. In the occurrence, Ram Pratap Singh and others also received injury.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the specific allegation to cause injury at the head of the informant through rod is against Ajit Yadav and Deepak Kumar. There is general and omnibus allegation against the petitioner and Tana Singh to commit "Maar-Peet" with the informant through lathi and danda. The petitioner has no criminal antecedent and is in custody since 13.12.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri V.K. Singh, Judicial Magistrate, First Class, Dehri, District-Rohtas, in connection with Dehri (Indrapuri) P.S. Case No.734 of 2019.
