The petitioner seeks bail in Kadamkuan P.S. Case No. 117/2016, registered for the offences punishable under Sections 392 and 511 of the Indian Penal Code and Sections 25(1-B)A and 26 of the Arms Act.

The informant alleged that three persons surrounded him at Bari Path near Churi lane situated at Bakarganj. Then they made attempt to snatch his bag, but somehow the informant fled away after snatching pistol from possession of the accused. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The petitioner has falsely been implicated in the case by the police, who arrested the petitioner and took his confessional statement. Save and except confession

Patna High Court Cr.Misc. No.11003 of 2017 (2) dt.07-03-2017 2/2 of the petitioner before the police, there is no other material to show the involvement of the petitioner. The petitioner is in jail since 28.07.2016, but he has not been put on Test Identification Parade.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for about eight months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Kadamkuan P.S. Case No. 117/2016.
