The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 379, 504 of the Indian Penal Code and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.

It is alleged that the informant took Rs.

65,000/- friendly loan from the petitioner on interest when he went to make repayment of loan amount he was threatened, assaulted and abused by calling caste name.

It is submitted by learned counsel for the petitioner that the accusation has been levelled in the background of pendency of Title Suit No. 361 of 2013 between the petitioner and the informant and Complaint Case No. 502 of 2013 filed by the petitioner. A statement has been made in paragraph

Patna High Court Cr.Misc. No.11170 of 2015 (2) dt.18-03-2015 2 / 2 no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the accusation in the background of litigated relationship between the parties from before, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Madanpur P.S. Case No. 148 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Aurangabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
