2. The petitioner seeks bail in connection with Barh P.S. Case No. 470 of 2023 registered for the offence punishable under Sections 364(A)/34 of the Indian Penal Code.

3. A five year old boy was kidnapped. He was recovered on the same day due to the pressure of the police. During investigation, it has come that the petitioner has participated in the kidnapping of the victim boy. The petitioner is in jail since 21.08.2023.

4. Considering the fact that this is a case of

Patna High Court CR. MISC. No.14223 of 2024(3) dt.26-04-2024 2/2 kidnapping of a five year old boy and is punishable with capital punishment, I am not inclined to grant bail to the petitioner.

5. Accordingly, this application stands dismissed.
