The petitioners have preferred this application for grant of regular bail in a case registered under sections 392, 364A and 34 of the Indian Penal Code.
As per the prosecution case, the accused persons
Patna High Court CR. MISC. No.12010 of 2022(3) dt.22-12-2022 2/3 including the two petitioners herein are said to have stolen Rs.30,000/ in cash, of having forcibly taken away the son of the informant and of making demand of ransom to the tune of Rs. 5 lacs.
It is submitted by learned counsel for the petitioners that the informant and the petitioners as also the other accused persons are all neighbours and it is as a result of other disputes that this false case has been lodged. It is for this reason that no information was given to the police outpost which is close-by. Even the alleged kidnapped victim returned immediately unharmed. The petitioners are in custody since 8.10.2021 and 12.10.2021. Investigation in the case is complete. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegations together with the contents of the statement under section 164 Cr.P.C. of the victim wherein also he has named the petitioners and made direct allegation against them including having stated that so far as demand of ransom etc. is concerned, they have recording of the same, the Court is not inclined to enlarge the petitioners on bail and the application is rejected. In view of the fact that the petitioners are in custody since 8.10.2021 and 12.10.2021 and chargesheet has been submitted,
Patna High Court CR. MISC. No.12010 of 2022(3) dt.22-12-2022 3/3 liberty is granted to the petitioners to renew their prayers for bail after framing of charge.
