The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/323/307 of the Indian Penal Code, section 27 of the Arms Act and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. It is alleged that the accused persons assaulted one Indradev Manjhi with 'lathi' and stick when villagers came to rescue they were also assaulted by them. The accused person also resorted to fire.
It is submitted by learned counsel for the petitioners that 6 persons received simple injury but the accusation of assault is omnibus and general.
Patna High Court Cr.Misc. No.15628 of 2015 (2) dt.04-05-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Wazirganj P.S. Case No.117 of 2014, pending before the Chief Judicial Magistrate, Gaya.
With the above observation, this application is, accordingly, disposed off.
