1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 307/34 and 120(B) of the Indian Penal Code and Section 27 of Arms Act.

3. The learned counsel for the petitioner submits that the petitioner is in custody since 15.12.2024, he is a person with clean antecedent and the informant alleges that on 15.07.2023 at about 9.10 P.M. while he was sitting on the bridge near the Saloon of Mintu Thakur, when the named accused persons including 8-10 unknown accused along with the petitioner came armed with pistol and accused Shyam Bihari started firing with an intent to kill the informant, but the informant narrowly

4. It is submitted that from perusal of the allegation as alleged in the FIR, it would manifest that petitioner is not alleged to have fired rather it is alleged that it was on the orders of the petitioner that Shyam Bihari fired, but then, no one was injured. It is further submitted that petitioner a senior citizen aged about 63 years.

5. Learned A.P.P. opposes the bail application.

6. Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gaya Muffasil P. S. Case No.763 of 2023.

7. The application stands allowed.
