2. The petitioner has preferred this application for grant of regular bail in connection with Goreakothi P.S. Case No. 197 of 2024 registered for the offences punishable u/s 25(1B) (a), 26 and 35 of the Arms Act.
3. As per the prosecution case, the police in the process of investigation of Goreakothi P.S. Case No. 196 of 2024, received some secret information that the accused of the said case was about to flee, however, the police apprehended the said person who disclosed his name as Kamlesh Sahani (petitioner) and on his confession, a country made pistol with four live cartridges were recovered from a bush.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that no incriminating article has been recovered from the conscious possession of the petitioner. It is lastly submitted that the petitioner has four criminal antecedents and is in custody since 22.08.2024.
5. Learned APP for the State has vehemently opposed the prayer for bail and has stated that the petitioner carries criminal antecedents and he is involved in the cases of similar nature of offence, hence, he does not deserve the liberty of bail.
6. Considering the aforesaid submissions of the parties and taking into account the period of custody, let the petitioner above-named, be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Siwan, in connection with Goreakothi P.S. Case No. 197 of 2024.
7. The application stands allowed.
