The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366 and 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement, the victim got her age recorded as 16 years when the court assessed her age as 18 years. Though as per medical report the victim is aged 16 to 18 years but in the statement under section 164 Cr.P.C. she stated that she of her own married with the petitioner and wants to live with him. Case No. 938 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
