JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A, 376 and 120B of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant and establishing forceful physical relationship. It is submitted by learned counsel for the petitioner that though, in 164 Cr. P.C., statement, the victim girl has named this petitioner and others who took the victim girl to confine her in a room but the accusation of establishing forceful physical relationship has been levelled against Lalti Soren who has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 34142 of 2013. The said order has been brought on record as Annexure-3. A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.8196 of 2015 (2) dt.04-03-2015 2/2 petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Araria in connection with Baunsi P.S. Case No. 28 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
