The petitioner seeks bail in a case instituted under Sections 307, 302, 120(B)/34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 10(29)(1)/14/16/18/20 of the U.A.P.A. Act.
The prosecution story, in brief, is that the accused persons including the petitioner assaulted the father of the informant and Bishwajeet with pistol, causing firearm injury on the head, chest and thigh of the father of the informant and on the stomach of Bishwajeet. The cause of incident is that prior two months, one Ganesh Thakur, who is a member of P.L.F.I., had demanded Rs. 20 lac, as rangdari from Bishwajeet Kuma, which
Patna High Court Cr.Misc. No.6740 of 2017 (3) dt.03-03-2017 2/2 was not fulfilled by him.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.11.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. Except for suspicion, there is no other material to suggest his implication in the present case. There is no eyewitness to the alleged occurrence. The other co-accused has been granted bail vide Anneuxre-2 to the present application.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa, Nalanda in connection with Hilsa P.S.
