2. The petitioner apprehends his arrest for the offences alleged under Sections 420, 467, 468, 469, 384, 385, 328 and 471 of the Indian Penal Code registered in connection with Complaint Case No. 4135 of 2012/ 43 of 2013.

3. It is submitted that the petitioner has been falsely implicated and he was merely a witness in the sale deed relating to the land purchased by co-accused Durgesh Kumar who has been granted anticipatory bail by this Court in Cr. Misc. No. 46798 of 2015. Title Suit No. 933 of 2012 has already been filed by the husband of the complainant. Petitioner claims clean antecedents.

4. Despite the notice being validly served on the opposite party no. 2, none has entered appearance on her behalf when the matter is called.

5. Having regard to the entirety of the facts and circumstances of the case, the provisional anticipatory bail granted

Patna High Court Cr.Misc. No.8312 of 2016 (3) dt.07-09-2016 2/2 to the petitioner by order dated 18.04.2016 by this Court in connection with Complaint Case No. 4135 of 2012/ 43 of 2013 pending in the Court of learned Chief Judicial Magistrate, Vaishali at Hajipur is hereby confirmed.
