JUSTICE BIBEK CHAUDHURI ORAL ORDER 24-04-2025 11 accused persons including the present appellant/C.I.C.L. were booked for committing offence under Sections 143/341/323/307/325/379/504/506/302 of the I.P.C., in connection with Sahebpur Kamal P.S. Case No. 47 of 2024.
2. Since the appellant is a juvenile, he was sent to the Juvenile Justice Board to face trial. Subsequently, considering the age of the appellant, his case was transferred to the Court of the learned Special Judge (Children Court) at Begusarai. The case of the appellant was registered as J.J.C.P. Case No. 9 of 2024. The appellant prayed for bail before the learned Special Judge (Children Court), Begusarai but vide order dated 20th
Patna High Court CR. APP (SJ) No.791 of 2025(3) dt.24-04-2025 2/3 January, 2025, prayer for bail was rejected.
3. It is submitted by the learned Senior Counsel on behalf of the appellant that out of 11 accused persons, 10 accused persons were released on bail by the regular bail court. In support of his contention, he refers to two orders passed in Cr. Misc. No. 62553, dated 10th December, 2024 and Cr. Misc. No. 77896 of 2024, dated 26th November, 2024. The appellant prays for bail as he stands on the same footing with the major accused persons.
4. Considering all such aspect of the matter, the appellant is directed to be released from custody in connection with Sahebpur Kamal P.S. Case No. 47 of 2024, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each, one of whom must be one of the parents of the appellant, to the satisfaction of learned Juvenile Justice Board, Begusarai, with further condition that if on bail, the jurisdictional Probation Officer shall remain in touch with the appellant and submit quarterly report to the learned Juvenile Justice Board, Begusarai about the antecedent of the appellant.
5. If any adverse report is received, the Juvenile Justice Board, Begusarai is at liberty to cancel the order of bail of the appellant without further reference to this Bench.
