The petitioner, who is in custody, seeks bail in connection with Guraru P.S. Case No. 43 of 2016 registered under Sections 323, 341, 325, 307, 504/34 and later on added Section 302 of the Indian penal Code.
Allegation is that on the issue of milking of cow, the petitioner's husband gave a lathi blow over the head of his father. It is further alleged that this petitioner and her son also assaulted the informant.
The specific allegation of assault on head is against the husband of the petitioner but there is no specific allegation against this petitioner that she was armed with any weapon and the death, according to the postmortem report, was caused due to head
Patna High Court Cr.Misc. No.6175 of 2017 (2) dt.08-02-2017 2/2 injury. The petitioner is the daughter-in-law of the deceased. Having considered the aforementioned facts and circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional sessions Judge- VII, Gaya in connection with S.Tr. No. 201 of 2016/450 of 2016 arising out of Guraru P.S.Case No. 43 of 2016.
