2. The petitioner seeks regular bail in a case registered for the offence under Section 21(b) of the NDPS Act.
3. As per the prosecution case, 10 gram of smack has been recovered from the possession of the petitioner.
4. Learned counsel for the petitioner submits that nothing incriminating has been recovered from the possession of the petitioner and the petitioner is in custody since 19.12.2023. Petitioner claims clean antecedent.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the recovery of intermittent quantity
Patna High Court CR. MISC. No.14906 of 2024(2) dt.12-03-2024 2/2 of smack and considering the clean antecedent, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, NDPS Act, Araria/concerned Court below in connection with Special Case No. 122 of 2023 arising out of Araria P.S. Case No. 1199 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Araria Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
