The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 30 (a) of the Bihar Prohibition and (Amendment) Excise Act, 2018. It is a case of recovery of country made liquor which kept in three gallons.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that nothing has been recovered from the conscious or constructive possession of the petitioners and they have no concern with the seized liquor or gallons and

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna City (Patna) in connection with Malsalami P.S. Case No. 53 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
