2. The petitioner seeks bail in connection with Bidupur P.S. Case No. 399 of 2024 registered for the offences under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita & Section 3/4 of the Dowry Prohibition Act.

3. The petitioner is named in the F.I.R. and is in custody since 20.07.2024.

4. The allegation against the petitioner is to cause death of daughter of the informant along with other family members/co-accused persons due to non-fulfillment of

Patna High Court CR. MISC. No.12926 of 2025(4) dt.24-07-2025 2/3 demand of dowry as raised for four wheeler vehicle.

5. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is mother-in-law facing general and omnibus allegation. It is pointed out that the husband of deceased is in custody. Explaining the cause of death it is submitted that deceased daughter-in-law of petitioner was a short tempered lady and committed suicide, which appears corroborating from post-mortem report when cause of death mentioned as "asphyxia". It is also submitted that petitioner being mother-in-law was not connected with the daily and domestic affairs of deceased wife and her husband. While concluding the argument it is submitted that petitioner is a lady of clean antecedent and moreover, the prayer of bail of father-in-law namely Binod Das @ Vinod Das facing similar allegation was granted bail by one of the learned Co-ordinate Bench of this Court through order dated 13.05.2025.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

7. In view of aforesaid facts and circumstances as

No.12926 of 2025(4) dt.24-07-2025 3/3 mentioned above and by taking note of fact as petitioner being mother-in-law prima-facie appears facing general and omnibus allegation and moreover death appears out of suicide, coupled with the fact as petitioner is in custody since 20.07.2024, accordingly above named petitioner, is directed to be released on bail in connection with Bidupur P.S. Case No. 399 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
