This application is for grant of bail in connection with Barun P.s.Case No.147 of 2016 for the offence under Sections 8, 20(b) (ii) (B) of the N.D.P.S. Act.
It is submitted on behalf of the petitioner that there is allegation of recovery of 08 kg. of "Ganja" but it was not for the purpose of commercial use. The petitioner is in custody for about four months.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of the fact that 08 kg. of Ganja has been recovered from the possession of the petitioner, I am not inclined to grant bail to the petitioner, however, the
Patna High Court Cr.Misc. No.7807 of 2017 (2) dt.22-02-2017 2/2 petitioner is in custody for about four months, the learned trial court is directed to expedite the trial.
With the aforesaid observation, this application is dismissed.
