Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Mairwan P.S. Case No. 39 of 2022 instituted for the offence under Section 30(a), 38(i),41 (i) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 30.01.2022 and charge-sheet has been submitted and is a person of clean antecedent and allegation is of recovery of 339 litres of liquor from a Santro Car.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.12136 of 2022(2) dt.21-03-2022 2/2 petitioner has no concern with the alleged recovery as petitioner has taken lift in the car and was not aware what was kept in the car.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted and petitioner has clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.5000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. -1, Siwan, in connection with Mairwan P.S.
