2. Petitioner apprehends arrest in a case registered for the offence punishable under section 272 and 273 of the IPC Section 30 (a) ( d ) of the Bihar Prohibition and Excise (Amendment ) Act 2018 .

3 . Prosecution case is that 20 liters country made liquor along with apparatus used in manufacturing of liquor were recovered from the spot.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has

5 . Learned counsel for the State opposed the bail petition and submits that this bail application has been moved after the lapse of more than 3 and half years of the institution of F.I.R., for which there is no explanation .

6. Considering the fact that this bail application has been filed after lapse of more than 3 and half years for which there is no explanation and other circumstances of case , the prayer for pre - arrest bail of petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
