The petitioner seeks bail in connection with Samastipur (M) P.S. Case No.263 of 2016 registered under Sections 363, 365 and 366(A) of the Indian Penal Code.
The accusation of the informant Satyanarayan Sah is that on 06.09.2016, in the morning, his son Raja Kumar, aged about 13 years, and daughter Priyanka Rani, aged about 16 years, had gone to Holi Mission School (Mohanpur). While the daughter of the informant remained standing on the gate, his son went to the class. At about 11.00 A.M., a call was made by the daughter of the informant on mobile no.7561996289 through mobile
Patna High Court Cr.Misc. No.8222 of 2017 (3) dt.08-04-2017 2/3 no.7250070764, which was received by Chandramani Kumar, another son of the informant, by which her daughter informed him weeping that she has missed the place.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner used to do the work of labourer in the factory of the informant and due to love affair, the daughter of the informant left her parental house according to her own sweet will with the petitioner and stayed at Maharashtra from where both were apprehended. Thereafter, on the pressure of her family members, the daughter of the informant while stated about her kidnapping by this petitioner saying that the petitioner was annoyed with her father due to dismissal from service but she has not stated about any ill behaviour committed by this petitioner with her saying that she was only kept about 11⁄2 months in a room by this petitioner.
Further submission is that in the medical examination, the age of the daughter of the informant has been assessed in between 17-18 years. The petitioner having no criminal antecedent is in custody since 26.10.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.
