The petitioner is accused in connection with Jogbani (Bathnaha) P.S. Case No. 175 of 2019 registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1b)a/26/35 of the Arms Act. The accusation is that on receiving secret information about gathering of miscreants at Bathnahaghat Chouck for making plan to commit heinous crime, the informant along with other police personnel reached there. On seeing the police party, three persons started to flee away, but on chased, one was apprehended, who disclosed his name as Deepak Yadav, who was found in possession of country made pistol. On

Patna High Court CR. MISC. No.10182 of 2020(2) dt.02-03-2020 2/2 search of the house, two persons were also apprehended, who disclosed their names as Shrawan Yadav(petitioner) and Govind Thakur. On search, Sharavan Yadav (petitioner) was found in possession of one country made pistol and Govind Thakur was also found in possession of one live cartridge. Learned counsel for the petitioner submits that while petitioner is accused in three other cases, as detailed in paragraph 3 of the petition, but in all three cases, he is on bail and in the present case, he is in custody since 21.06.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Araria, in connection with Jogbani (Bathnaha) P.S.
