JUSTICE SANJAY PRIYA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Budha Colony P.S. Case No.95 of 2016 instituted for the offence under Sections 272 and 273 of the Indian Penal Code and Section 47(A) of the Excise Act. It is alleged that foreign liquor and country made liquor has been recovered from the house of this petitioner. Seizure list has been enclosed with the written report. It does not bear signature either of this petitioner or any other family members.

It has been submitted that there is no compliance of the provisions of Section 100(6) of the Cr.P.C. Moreover, from the written report it appears that the aforesaid liquor has not been recovered from the conscious possession of this petitioner. The

Patna High Court Cr.Misc. No.4348 of 2017 (2) dt.10-02-2017 petitioner is said to be in custody since 22.07.2016. In the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, Judicial Magistrate-1st Class, Patna in connection with Budha Colony P.S. Case No.95 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Arvind/- U T
