====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Special Case No.357 of 2020 arising out of Kishanganj P. S. Case No.482 of 2020, instituted for the offences under Sections 272, 273, 420, 120(B) of the Indian Penal Code and Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016. From bare perusal of the F.I.R., it would manifest that 3517.86 litres of Indian made foreign liquor is said to have been recovered from a truck.

Learned counsel for the petitioner submits that petitioner is person with clean antecedent and is in custody since 08.12.2020 and charge-sheet has been submitted in this case. Learned counsel for the petitioner further submits that petitioner

Patna High Court CR. MISC. No.22992 of 2021(2) dt.16-11-2021 2/2 is a Khalasi of the said truck, who was not aware of the fact that what was being carried in the said truck.

Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Excise Act, Kishanganj in connection with Kishanganj P. S. Case No.482 of 2020.

The application stands allowed.
