This application for grant of regular bail arises out of Koran Sarai P.S. Case No.05 of 2020 for the offence under Sections 341, 323, 379, 504 and 506/34 of the Indian Penal Code.
The petitioners are in custody since 23.01.2020. it is alleged in the First Information Report that when the informant was waiting for his uncle to come at the place of occurrence for him to take to his home village, the miscreants started asking about his address etc. They thereafter said to have snatched the petitioner's mobile phone and cash of Rs.5000/-. The petitioners are named in the First Information Report, who were identified by the informant.
Patna High Court CR. MISC. No.10318 of 2020(2) dt.28-02-2020 2/2 Learned counsel appearing on behalf of the petitioners has submitted that it is highly improbable for the petitioners to indulge in a criminal activity, as alleged in the First Information Report, knowing well that the victim knows their names. He has submitted that the petitioners have been falsely implicated because of reasons not, in fact, disclosed in the First Information Report.
Considering the facts and circumstances, this application is allowed.
Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar, in Koran Sarai P.S. Case No. 05 of 2020.
